2. Service Description
evaluate.hr provides an AI-assisted recruitment platform that enables HR professionals and organizations to:
- Create and manage job postings
- Upload and store candidate CVs and resumes
- Utilize AI-powered candidate ranking and assessment
- Track and manage recruitment workflows
- Analyze candidate qualifications and experience
We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice.
3. Eligibility and Account Registration
3.1 Eligibility
- You must be at least 18 years old to use this service
- You must be authorized to represent your organization (if applicable)
- You must provide accurate and complete registration information
- You must comply with all applicable laws and regulations
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Using strong passwords and enabling available security features
4. Professional Conduct and Ethical Standards for HR Professionals
As an HR professional using evaluate.hr, you commit to upholding the highest ethical standards and professional conduct:
4.1 Fair and Unbiased Recruitment
- Non-Discrimination: You will not discriminate based on race, color, religion, gender, gender identity, sexual orientation, national origin, age, disability, or any other protected characteristic
- Equal Opportunity: Provide all candidates with fair and equal consideration
- Merit-Based Decisions: Base hiring decisions on qualifications, skills, and job-related criteria
- AI Transparency: Understand that AI scores are advisory tools, not definitive judgments
4.2 Candidate Privacy and Dignity
- Respect Privacy: Handle candidate data with utmost confidentiality and respect
- Lawful Processing: Only collect and process data necessary for recruitment purposes
- Informed Consent: Ensure candidates are aware their CVs will be processed by AI
- Data Minimization: Delete candidate data when no longer needed
- Secure Handling: Protect candidate information from unauthorized access or disclosure
4.3 Transparent and Honest Communication
- Provide accurate job descriptions and requirements
- Communicate clearly about recruitment timelines and processes
- Be honest about compensation, benefits, and working conditions
- Inform candidates of AI-assisted evaluation if asked
- Provide constructive feedback when possible and appropriate
4.4 Responsible AI Usage
- Human Oversight: Always apply human judgment; never rely solely on AI scores
- Review and Validate: Cross-check AI assessments with manual review
- Understand Limitations: Recognize that AI may have biases or limitations
- Fairness Monitoring: Regularly audit your hiring outcomes for potential bias
- Candidate Rights: Honor requests for human review of AI-generated assessments
4.5 Professionalism and Integrity
- Maintain professional relationships with candidates
- Avoid conflicts of interest in hiring decisions
- Respect confidentiality of both candidates and your organization
- Conduct yourself with honesty, fairness, and respect at all times
- Comply with all applicable employment laws and regulations
Violation of these ethical standards may result in immediate suspension or termination of your account.
5. Acceptable Use Policy
5.1 Permitted Uses
You may use evaluate.hr for legitimate recruitment and HR purposes only.
5.2 Prohibited Activities
You agree NOT to:
- Upload false, misleading, or fraudulent job postings
- Collect candidate data for purposes other than recruitment
- Share, sell, or distribute candidate data without authorization
- Use the platform to discriminate against candidates
- Scrape, harvest, or extract data from the platform using automated means
- Attempt to gain unauthorized access to our systems or other users' accounts
- Upload malicious files, viruses, or harmful code
- Reverse engineer, decompile, or disassemble any part of our software
- Violate any applicable laws, regulations, or third-party rights
- Interfere with or disrupt the platform's operation
- Use the platform for any illegal or unauthorized purpose
6. Fair Usage and Resource Limits
To ensure service quality for all users, we implement fair usage limits:
6.1 Storage and Upload Limits
- CV file size: Maximum 50MB per file
- Bulk upload: Up to 400 files per batch
- Supported formats: PDF, DOC, DOCX only
- Total storage limits apply based on your subscription tier
6.2 API and Processing Limits
- There are limits on how many candidates can be scored in a given time period
- Unusually heavy or abusive usage may be slowed down or temporarily restricted
- Large-scale automated operations require prior approval from our team
6.3 Good Faith Usage
We expect all users to use the platform in good faith and for its intended purpose. Patterns of abuse, excessive resource consumption, or attempts to circumvent limits may result in service restrictions or account termination.
7. Data Ownership and Intellectual Property
7.1 Your Data
- You retain all ownership rights to the data you upload (job descriptions, candidate CVs, etc.)
- You grant us a limited license to process this data solely to provide our services
- You are responsible for ensuring you have the right to upload and process candidate data
7.2 Our Intellectual Property
- evaluate.hr platform, software, AI models, and branding remain our exclusive property
- You receive a limited, non-exclusive, non-transferable license to use the platform
- You may not copy, modify, or create derivative works from our platform
7.3 AI-Generated Scores
AI-generated candidate scores and assessments are provided to assist your decision-making. While you may use these insights, you acknowledge that final hiring decisions are your responsibility and must comply with all applicable laws.
8. Payment and Subscription Terms
- Subscription fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law
- We may change pricing with 30 days' notice to existing customers
- Failure to pay may result in service suspension or termination
- You are responsible for all applicable taxes
9. Service Availability and Support
9.1 Uptime and Availability
We strive to maintain high service availability but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance when possible.
9.2 Support
- Support is provided via email and in-app messaging
- Response times vary based on your subscription tier
- We provide support in English
- Technical documentation and guides are available in our knowledge base
10. Termination
10.1 Termination by You
You may cancel your account at any time through your account settings. Upon cancellation:
- Access to the platform will end at the conclusion of your billing period
- Your data will be retained for 90 days, then permanently deleted
- You may export your data before cancellation
10.2 Termination by Us
We may suspend or terminate your account if:
- You violate these Terms of Service
- You engage in prohibited activities or unethical conduct
- Your account shows patterns of abuse or fraudulent activity
- Payment obligations are not met

11. Disclaimers and Limitations of Liability

11.2 AI Accuracy Disclaimer
IMPORTANT: AI-generated candidate rankings and scores are probabilistic assessments based on algorithms. We do not guarantee:
- Accuracy, completeness, or reliability of AI assessments
- That AI scores reflect actual job performance or candidate quality
- Freedom from bias or errors in AI processing
You are solely responsible for all hiring decisions. AI tools are meant to assist, not replace, human judgment and expertise.
11.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVALUATE.HR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.
12. Indemnification
You agree to indemnify and hold harmless evaluate.hr from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your violation of any rights of third parties (including candidate privacy rights)
- Your hiring decisions or employment practices
- Data you upload or process through the platform
13. Governing Law and Dispute Resolution
13.1 Governing Law
